Charity Overview - Disclosure and Barring Service Checks
# DBS Checks
- Basic Disclosure Checks - will disclose details of any unspent convictions and conditional cautions
- Standard Disclosure Checks - will disclose details of spent and unspent convictions, cautions, warnings and reprimands
- Enhanced Disclosure Checks - will disclose the same information as a standard check but can also include other non-conviction information that the police believe is relevant to the workforce applied for.
- Enhanced Disclosure with Barred List Checks - will disclose the same information as an Enhanced Disclosure Check and include a check of the Children’s Barred List (and others if relevant)
# Children's Charity
"For DBS purposes, a charity is a children’s charity if the charity workers/volunteers include those who carry out work that falls into the legal definition of regulated activity with children"
# Regulated Activity
"Regulated activity is something that must not be done by a person who is barred"
These activities require Enhanced DBS Check with Children’s Barred List check.
3+ times in 30-day period:
- Teaching, training or instructing children
- Caring for or supervising children
- Providing any form of advice or guidance
- Day-to-day management or supervision of a person carrying out regulated activity
Regular involvement, with opportunity of contact with children, in the following establishments would be classified as a regulated activity, if 3+ times in a 30-day period:
- An educational institution exclusively or mainly (...) for children
- Relevant childcare premises
# Work with Children
Working in a role that is not an unregulated activity but has contact with children: Enhanced Disclosure Check
# Regulated Activity Provider
"An organisation that has any number of roles that meet the definition of regulated activity"
- legal duty to make referrals to the DBS (...) believe a person:
- has caused harm (to vulnerable groups, including children)
- poses future risk of harm (to vulnerable groups, including children)
- Must provide information to DBS when requested to do so.
# Charity Trustees
Role of trustee can be asked to apply for Enhanced Disclosure Check, no addition Barred list required. Taking on a role that involves engaging with a regulated activity will require the full check.
